1. Purpose
This Acceptable Use Policy (“AUP”) governs how you may use the TextMe platform (“Platform”). It applies to all users, including content creators (“Creators”), agency operators (“Agencies”), team members (Typers, Managers), and content purchasers (“Fans” or “Buyers”). This AUP is incorporated by reference into our Terms of Service.
Violation of this AUP may result in immediate account suspension or termination, forfeiture of outstanding earnings, and referral to law enforcement where applicable.
2. Age Requirements
- You must be at least 18 years of age to use the Platform in any capacity — as a Creator, team member, or Buyer.
- All individuals depicted in any visual content uploaded, distributed, or sold through the Platform must be at least 18 years of age at the time the content was created.
- Creators are solely responsible for verifying and documenting the age of all individuals depicted in their content in compliance with 18 U.S.C. § 2257.
- TextMe reserves the right to require government-issued photo identification to verify the age and identity of any user at any time.
- Any content that depicts, or appears to depict, individuals under the age of 18 will be immediately removed, the account will be permanently terminated, and the matter will be reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement authorities.
3. Prohibited Content
You may not upload, distribute, sell, transmit, or promote through the Platform any content that:
3.1 Absolutely Prohibited (Zero Tolerance)
- Depicts, suggests, or implies sexual activity involving minors (child sexual abuse material / CSAM)
- Depicts non-consensual sexual activity, including “revenge porn” or content shared without the depicted individual’s consent
- Depicts content obtained through hidden cameras, spy cameras, or any covert recording
- Promotes, facilitates, or constitutes sex trafficking or sexual exploitation
- Promotes or facilitates prostitution, escort services, or solicitation of sexual services for pay (in compliance with FOSTA-SESTA)
- Depicts bestiality or sexual activity with animals
- Depicts or promotes incest
- Glorifies or promotes acts of violence, self-harm, or suicide
- Constitutes or promotes terrorism or terrorist organizations
3.2 Also Prohibited
- Content depicting illegal drug use or manufacturing, or promoting illegal substances
- Content that promotes discrimination, hatred, or violence based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or medical condition
- Content depicting weapons (firearms, knives, explosives) in a sexual context
- Malware, viruses, spyware, or any code designed to disrupt, damage, or gain unauthorized access to systems
- Content that infringes upon the intellectual property rights (copyright, trademark, trade secret) of any third party
- Content that violates any applicable local, state, national, or international law or regulation
- Deepfakes or AI-generated content depicting real, identifiable individuals without their explicit written consent
- Doxxing, stalking content, or content that reveals another person’s private information without consent
4. Content Requirements for Creators
- Ownership: You must own all content you upload, or possess a valid, documented license or model release granting you the right to distribute and sell it.
- Consent: All individuals appearing in your content must have provided explicit, documented consent to appear and for the content to be distributed commercially.
- Record-Keeping: Creators producing sexually explicit content must maintain records in compliance with 18 U.S.C. § 2257, including verified identification of all performers. See our 18 U.S.C. § 2257 Compliance Statement for details.
- Accurate Representation: Content must not be misleadingly described. PPV previews/descriptions must accurately represent the content being sold.
- Tax Compliance: Creators and Agencies are solely responsible for reporting and paying all applicable taxes on income earned through the Platform.
5. Prohibited Platform Uses
You agree not to use the Platform to:
- Send unsolicited messages or spam to individuals who have not opted in to receive communications from you
- Engage in phishing, social engineering, or attempts to obtain another user’s credentials
- Impersonate any person, business, or entity, or falsely represent your affiliation with any person or entity
- Scrape, harvest, crawl, or use automated means to access the Platform or collect user data
- Reverse engineer, decompile, or disassemble any portion of the Platform
- Circumvent or attempt to circumvent any access controls, security features, rate limits, or usage restrictions
- Resell, sublicense, or provide access to the Platform to unauthorized third parties
- Engage in any form of financial fraud, money laundering, or payment manipulation
- File fraudulent chargebacks or payment disputes
- Create multiple accounts to circumvent a ban, suspension, or usage restriction
- Use the Platform to facilitate or promote any activity that is illegal in the jurisdiction of the user or the depicted individuals
- Interfere with, disrupt, or place an unreasonable load on the Platform’s infrastructure
6. Messaging and Communication Rules (TCPA Compliance)
The Platform delivers messages through iMessage via a third-party service provider that manages real iPhone devices. TextMe does not directly manage or operate the iPhone devices used for iMessage delivery; this infrastructure is entirely managed by a third-party provider. All users must comply with the Telephone Consumer Protection Act (TCPA) and applicable anti-spam laws:
- Consent: You must have prior express written consent from fans before sending marketing or promotional messages. Fans must affirmatively opt in to receive messages.
- Opt-Out: You must honor opt-out requests within 10 business days. Fans may revoke consent through any reasonable method, including informal messages such as “stop,” “unsubscribe,” “leave me alone,” or similar expressions.
- One Confirmation: You may send only one post-opt-out message to confirm the scope of the revocation.
- Identification: Messages must clearly identify the sender. Misleading sender information is prohibited.
- Mass Text: Mass text campaigns must only target fans who have opted in. You may not purchase or use third-party contact lists.
- Frequency: Do not send messages at excessive frequency. TextMe reserves the right to throttle or restrict messaging for accounts that generate excessive complaint rates.
Violations of TCPA carry statutory damages of $500 to $1,500 per message per recipient. TextMe is not responsible for damages arising from your messaging practices.
7. Intellectual Property and DMCA
7.1 Copyright Policy
TextMe respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We will respond expeditiously to valid takedown notices.
7.2 Filing a DMCA Takedown Notice
To submit a takedown notice, you must provide:
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material to be removed, with sufficient information to locate it
- Your contact information (name, address, telephone number, email)
- A statement that you have a good faith belief the use is not authorized
- A statement, under penalty of perjury, that the information in the notice is accurate and you are authorized to act on behalf of the copyright owner
- A physical or electronic signature of the authorized person
7.3 Counter-Notification
If you believe your content was wrongly removed, you may file a counter-notification containing your contact information, identification of the removed content, a statement under penalty of perjury that removal was a mistake, and your consent to jurisdiction.
7.4 Repeat Infringers
In accordance with the DMCA, TextMe will terminate the accounts of users who are repeat copyright infringers.
8. Buyer/Fan Obligations
- Content purchased through the Platform is for personal, non-commercial use only.
- You receive a limited, non-transferable, non-sublicensable license to view purchased content. You do not acquire ownership rights.
- Redistribution is strictly prohibited. Sharing, re-uploading, screen recording, screenshotting for distribution, leaking, or any unauthorized reproduction of purchased content may result in account termination, civil liability of up to $150,000 per work under the Copyright Act, and criminal prosecution.
- All sales of digital content are final. Chargebacks filed fraudulently will result in account termination and may be reported to law enforcement.
9. Team Member Responsibilities
- Team members (Typers, Managers) act under the authority and direction of the Creator or Agency that employs them.
- Team members must operate strictly within the permissions assigned to them by their employer via the Platform’s role-based access controls.
- Team members must not share account credentials, access content outside their assigned scope, or misuse access for personal gain.
- The Creator or Agency is responsible for the actions of their team members on the Platform.
10. Enforcement and Reporting
TextMe reserves the right to:
- Remove any content that violates this AUP without prior notice
- Suspend or terminate any account that violates this AUP
- Withhold or forfeit earnings associated with content that violates this AUP
- Report violations to law enforcement, NCMEC, or other relevant authorities
- Cooperate with law enforcement investigations
To report a violation of this AUP, please contact us through the Platform support channels with as much detail as possible, including URLs, usernames, and descriptions of the violation.
11. FOSTA-SESTA Compliance
In compliance with the Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA) and the Stop Enabling Sex Traffickers Act (SESTA), TextMe strictly prohibits the use of the Platform to promote, facilitate, or engage in prostitution, escort services, sex trafficking, or the solicitation of sexual services. The Platform is designed exclusively for the sale of digital content (photos, videos, messages) — not in-person services of any kind. Violations will result in immediate termination and referral to law enforcement.
12. Modifications
TextMe reserves the right to modify this Acceptable Use Policy at any time. Material changes will be communicated at least 30 days before taking effect. Continued use of the Platform after the effective date of changes constitutes acceptance.
By using TextMe, you acknowledge that you have read, understood, and agree to comply with this Acceptable Use Policy.
